I didn't discover this problem on my test drive 'cause the initial bite is fine and it'll do an E-stop no problem. Perhaps a 2006 Civic on cheapo pads just has shit brakes compared to a Beemer on decent ones! Gonna have to take it easy on them roundabouts, which goes against every instinct.

It would be weird the the problem only appears sometimes though....I did load of test e stops yesterday from cold and it was fine. It will put you through the windscreen no problem. Stamping on the pedal willy nilly activates the ABS too. I also know what unservoed brakes feel like, this doesn't seem like that.
Also passed the MoT (which includes a brake force check) just before I got it, which doesn't mean that much I know.

Smelly brake pads is just a symptom.
The question is why are the pads are staying in contact with the disc and getting hot and smelly? It's not many things that will cause that and they're all easy to check and rectify.

Basically yes. The piston may be seized in the caliper, or may be slightly offset in the caliper. The piston's rubber seal could be fucked - they flex a bit when the brake is applied and then re-assert themselves when the brake is released to just ease the pads away from the disc. The disc may be warped so that the brake pads are coming into contact on each wheel revolution, not stuck on but enough contact to cause excess wear, heating and smell. Discs may be past their wear limit allowing the pistons to protrude too far out of the caliper where they can become offset.
Brakes are pretty basic (unless you're going to make them from scratch and calculate master and slave cylinder pressures/movement etc), bits are easily replaced etc. The one thing that most people like me don't have is the sucking of teeth technique and "Well it's brakes, innit. Ain't gonna be cheap darlin'" dialogue.
