Public Video Submissions

The other day on the R9 thread we were talking about the Police using video submitted by the public...

I've just been informed of 'Consideration being given to prosecuting the driver for Careless or Inconsiderate driving' for a Motorcycle I owned 5days after I sold it and interestingly 5 days after DVLA sent printed acknowledgment of the sale (the Acknowledgment states date printed).
They state no action will be taken this time but obviously I've emailed the 'capture team' (they give no other contact details) notifying them of the error and more importantly asking them to remove me from their records which they state they will keep.

I think that all police cameras etc need to be calibrated regularly.
Stuff used by public doesn't need or have any checks.
Surely a good lawyer could find loopholes?

Depends what it is. A lot of the vids I've seen posted by police are dodgy overtakes on solid whites, that sort of thing rather than speed per say.

No loopholes in absolute offences, as long as the date is correct on the evidence.
When it comes to speeding or opinion, that's a different matter.

In this instance the rider passed a horse (camera was on horse rider) on the centre line with the horse well to the left with a car approaching in the other direction. No mention of speed only that he should have given two metres clearance. Judging by how far the motorcycle moved in the 2 shots compared to other cars I think he did it slowly.

I've been thrown by a horse so I am sympathetic to the horse rider.

I'm less impressed with the camera team contacting me 8 days after DVLA acknowledged change of owner and stating they will keep it on file with an incorrect record of the rider

If I filmed with a camera or phone, the date could be altered.
Not all cars have GPS.

Speed is simply time and distance (miles in an hour).

GPS data, as said, will give time. That can be matched to the frame rate of the video (typically 25, 30 or 50 frames per second.

For distance, either measure between known points, or use white line markings which are painted at specified lengths and spacings.
Even bland can be a type of character :wave:

Date and time doesn't have to be correct, but it's obviously preferred.

It's your eyewitness testimony which is used to hang people, not the video itself, IYSWIM. So the video just backs up what you say.

If you lie in your testimony....well...that's a crime.

Ideally the date and time should be correct. The video footage is used to support your written witness testimony. Your witness statement must clearly state what time/date the incident occurred. You must account for any discrepancies in date/time within the evidence you present to us.
