Dealer warranty
Dealer warranty
Bought a 5yr old Morini Scrambler on 3rd of August, got it back home okay but then it went "frizzle smoke oh dear" when I started out on my first ride after that, had 6 month dealer warranty on it so they collected & fixed it, but not yet delivered it back to me. Presumably I should be asking for 6 month warranty from date of when they actually return it

That's why I suggested checking the consumer legislation. Should have been more specific.MrLongbeard wrote: ↑Mon Sep 11, 2023 4:20 pmS'not how it usually works, IIRC the date applies to the purchase date
Look to see what's reasonable for repair, both in time taken and number of instances.
Also whether right to reject is an option on used sales.
Potentially: "You won't restart the warranty? Ok, you obviously don't trust it either, so I'll reject it as not suitable for purpose. Can I have my money back, please."

I thought money back was only a 30 day thing.Horse wrote: ↑Mon Sep 11, 2023 4:37 pmThat's why I suggested checking the consumer legislation. Should have been more specific.MrLongbeard wrote: ↑Mon Sep 11, 2023 4:20 pmS'not how it usually works, IIRC the date applies to the purchase date

Re: Dealer warranty
Apart from riding it home, I've done zero miles on it, irrespective of what is legal you would have thought a reasonable dealer would extend warranty to start again from when they return the bike or at least I would - was just asking the collective mind if that is being a reasonable expectation. Ta

Re: Dealer warranty
Well it's been 6 weeks, so I can see why the dealer may frown. But as you say, that's only it's 2nd time ridden
It's not an unreasonable request.

Re: Dealer warranty
I'd email them and ask when you are getting the bike back and chuck a, I presume you will be resetting the 6 month warranty as the bike was never actually ridden and you've had it for X number of weeks.
If they don't reset it, personally that'd spark my spidey senses and I'd be doing everything I could to back out. It might be outside of 30 days or whatever but I'd say breakdown on first attempted ride and no bike for summer is grounds for not fit for purpose

Re: Dealer warranty
Reasonable maybe, but he'd be a bankrupt dealer in no time flat, with portion of his sales being retuned just before the warranty ran out to fix stuff and be renewed every time, he'd soon become Triggers Broom Emporium

Re: Dealer warranty
Maybe if only a week was left on the warranty, but this was the first ride. I'd say that changes a lot.MrLongbeard wrote: ↑Mon Sep 11, 2023 6:21 pmReasonable maybe, but he'd be a bankrupt dealer in no time flat, with portion of his sales being retuned just before the warranty ran out to fix stuff and be renewed every time, he'd soon become Triggers Broom Emporium

Re: Dealer warranty
Maybe, although maybe the better option would have been to reject it if it done gone F'ed up in such short order.Supermofo wrote: ↑Mon Sep 11, 2023 6:30 pmMaybe if only a week was left on the warranty, but this was the first ride. Re: Dealer warranty
I'd only expect any warranty re-set on the specific issue that occurred & its repair.
Hope you get your problem sorted out.

Re: Dealer warranty
Definitely do some research and go armed with full info. I wouldn't necessarily use the info unless it's needed, softly softly approach first
Good luck

Re: Dealer warranty
Definitely ask the question - but be prepared to argue if they aren't helpful. TBF, I'd argue even if the 'law' says you are not entitled!!!

Re: Dealer warranty
I would expect some sort of warranty for the work carried out, so maybe 6 months for what’s been repaired and the rest still covered up to 6 months after purchase date.

Re: Dealer warranty
Sale of goods states that merchandise must be of merchantable quality.
Stuff the warranty,
a. they are liable for defects for a reasonable period (more than 6 months!)
b. I would have had my money back by now.
c. A stiff letter suggesting that they are in breach of contract and that you are past patient and wanting a resolution and are prepared to take it further.

Re: Dealer warranty
Nope. There have been several threads on here or the previous forums about rejecting vehicles. Dealers must ensure the vehicles sold are in good condition, fit for purpose and reflect price and mileage.
The dealer should have a chance to fix a problem but if after a reasonable time a full repair cannot be completed - or if a repair is impractical - you can reject it.
I got almost all of my money back after rejecting a people carrier after I discovered a bunch of undeclared faults a couple of months after I bought it. I had to engage an independent expert to examine it but ignorance of a fault is no defence for the seller. Even 'sold as seen' is no legal defence if you sell a faulty product.
Plenty of articles on Google.
