Sale Of Goods Act.

Just seen this letter on another forum. It was used to get a camper van fixed outside of the 1 year warranty. Thought it might be useful.
Would it cover bikes I wonder?
Dear xxxxx,
Thanks for your reply, but I think you missed my point from my earlier email. Under my Consumers Rights I just need to deal with you as the retailer that sold me the equipment.
As the retailer, you must fix/repair, exchange or give a full refund on anything that has a defect or fault where the item would be expected to last at least 6 years, under the Sale of Goods Act 1979 and Consumer Rights Act 2015. Please ask your manager to read this if he is still not clear. This law stands, regardless of any stated Manufacturer warranty.
I don't mind if you (the dealer) or they (the manufacturer) pay for the repair, as long as it gets done.
So, in short, if you (the dealer) cannot get them (the manufacturer) to change their mind, then you will need to arrange the repair at your own cost.

Go on citizens advice bureau website and there are templates for similar letters to exercise your legal rights.
I've recently done two to a local car dealer, who I will possibly be taking to small claims court depending on his reply to the last one sent.

Your cases
Bought second hand car (from dealer) realised within couple of days it had a couple of problems - took it back and they sorted them. Ok, no great bother.
Couple of weeks later, another problem.. returned and repaired.
Little bit irked.
Within weeks had another problem, took it back to be repaired.. got it back and it failed again following day.
Pissed off now.
Engineer sent out to look "as they don't know much about fuelling systems" found the problem was it hadn't been put back together correctly and so had come loose (fuel filter). Also spotted that a previous problem had been bodged.
Big row, got apology for the bodge and repair promised if it failed.
Then something else went wrong.. took it back to be repaired and got a repair bill. Told them to jog on and wrote legal letter stating why I shouldn't have to pay (they complained that I kept bringing it back with problems and they couldn't be expected to keep repairing them for free

).
Told them last chance, if the car failed again I was rejecting it.
Lasted just over a week, wrote told them I was rejecting and stated legal rights.. they replied with a polite and sympathetic letter (emphasis on the pathetic) refused my rejection.
Another letter written stating legal rights and demanding rejection / refund or I take them to court.

I looked into rejecting a car years ago, brand new and the dealer couldn't fix it. There's a small window it will work in as using and accepting repairs is is a form of acceptance. The problem is the dealers know how to steer you down a route that will scupper your chances of rejecting it.
I was lucky as I found another dealer that could fix it, trying to get my money back would have been more aggro than it was worth. Hope yours goes well.
One of the dealer tactics was to get their own expert report saying there was nothing wrong with it and it was within Vauxhall's tolerances, but they wouldn't say what those tolerances were.
I know, I bought a Vauxhall, my own fault.

Principle is great. Till the garage ignores the law then closes down
Currently trying to find out if the garage I bought the minibus from went bust or closed. Not sure it makes much difference to the legal case, but if they closed there's a possibility I can still try and get some money from them. If they went bust I have no chance

My ex bought a new Jeep several years ago. It spent more time being fixed at the dealer than it did in her possession the first year... including one 2 month spell where the dealership finally had someone come out from the factory to work on it.
It pleased me greatly

From the same family I had a Chrysler Grand Voyager that was exactly the same. Last big problem was when the fusebox caught fire. Apparently it was going to cost me £750 just in "investigation time" and it took me 30s in the dealers on Google to find that it was a common fault. I refused to pay, it ended up in court and I won.
There's a LOT of cars out there with a load of known faults that the garages are just waiting for the ignorant to bring back and to rip them off sorting out.
