My gut feeling is that the entirety of the prosecution would rest on whatever the driver said to the police after the accident. They are not as daft as we might hope and they use extremely subtle methods to effectively encourage people to make some admission.
Always best to say nothing, especially after a serious event, especially if you are convinced you've done nothing wrong.
