As for the Biden DOJ report, they absolutely destroyed any thoughts that he is mentally competent & stated he isn't fit to stand trial... so they didn't charge him. He couldn't remember when he became VP, when he left the office of VP & got the death of his son wrong by * several years*.
Diminished faculties was used to describe his memory, as was "painfully slow" & stated that he struggled to read his own notebook entries.

The problem with that is, it lists who it applies to... & doesn't list the President.. who (along with everyone else who was in DC on Jan 6th) hasn't been charged with insurrection or rebellion.
