There may be more to come out but on the face of it it doesn’t bode well for people who try to intervene and help.

The case could be covered by a common law defence of self-defence, which provides for the use of proportionate, reasonable force to protect oneself or others.

Re: In todays news...
It may be similar to police actions at the scene of serious road crashes. Until investigations are completed they won't know what has happened beyond [potentially dubious] witness statements.

Playing devils advocate here but the law might treat driving over someone slightly differently to "intervening".wheelnut wrote: ↑Tue Jan 25, 2022 7:24 am There may be more to come out but on the face of it it doesn’t bode well for people who try to intervene and help.

The driver appears to have deliberately killed someone. They’re right to charge him with murder, at an early stage.wheelnut wrote: ↑Tue Jan 25, 2022 7:24 am There may be more to come out but on the face of it it doesn’t bode well for people who try to intervene and help.

Self defence is a defence against a charge.

He may be, eventually.
Maybe the facts are completely different from what the story says, though.

Let's see if he is actually charged, they might have arrested him on suspicion but then do not charge him.JackyJoll wrote: ↑Tue Jan 25, 2022 10:43 amThe driver appears to have deliberately killed someone. Re: In todays news...
I think he has a couple of defence strategies available.
Against a murder charge he can admit to using the car to try and prevent the knife attack but certainly didn't mean to kill the guy - just stop him. That could drop the murder charge down to manslaughter.
Self defence is another and the most likely option but whatever the final charge and whatever the CPS put up as evidence there's not many juries would convict him in my opinion.

Depends on the media, if the BLM line gets trotted out and a big scene is made then he might because people are too afraid to stand up to them, lest they be labelled racists and cancelled.

Re: In todays news...
There is no shortage of possibilities.
Perhaps the stabber no longer had a weapon and was leaving the scene.
Perhaps the car driver knew the stabber and had a grudge against him.
Let’s hope the car driver was smart enough to say nothing to the police, without a lawyer.
For instance, it would be really stupid to tell them “I ran him over because….” That sort of statement would remove the possibility of it being an accident.

It's my understanding that with self-defence you have a duty to withdraw. I.e. if you could have saved yourself by legging it that's what you should have done - deliberately moving towards the incident undoes your claim it was self-defence?

Re: In todays news...
Common sense might favour investigating first, and arresting people when the facts are known.
If it is as clear cut as sugested he probably has a good defence, but being arrested for murder is no joke.
